READ CAREFULLY — THIS AGREEMENT INCLUDES A WAIVER OF LIABILITY AND LEGAL RIGHTS AND DEPRIVES YOU OF THE RIGHT TO SUE PINKMANTARAY LLC, SCHUYLER BAILAR, ANY FACILITATOR(S), AND OTHER WAIVED PARTIES.

For and in consideration of allowing me to participate in individual and/or group support sessions (“Support Sessions”)convened by Schuyler Bailar, one or more additional facilitators who may assist in or independently lead certain Support Sessions (“Facilitator(s)”), and/or Pinkmantaray, LLC, I, for myself and on behalf of my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make the following contractual representations:

I understand and acknowledge that Schuyler Bailar is not a licensed mental health professional, that this activity is not therapy, not a therapeutic session, and not a therapeutic group, and that no client/therapist relationship is formed by my participation in any Support Session facilitated by Schuyler.

I further understand and acknowledge that Facilitators may include licensed therapists or other licensed medical or mental health professionals, but their role in these Support Sessions is solely as Facilitators. Regardless of any professional credentials, Facilitators are not providing therapy, diagnosis, treatment, or individualized clinical care, and no therapeutic or clinical relationship is created between myself and any Facilitator by my participation. Any information provided in any Support Session is educational only and does not constitute the provision of medical, psychological, or other professional health care treatment services.

I also understand that any Facilitator who is a licensed professional remains a mandatory reporter under applicable law. This means that if information is disclosed during a Support Session that triggers a legal duty to report (such as suspected abuse, neglect, or imminent risk of serious harm), that Facilitator may be required to make a report to the appropriate authorities. This mandatory reporting obligation does not create a therapeutic relationship and does not alter the non‑clinical nature of the Support Sessions.

In exchange for allowing me to participate, I hereby waive and covenant not to sue, and further agree to indemnify, defend, and hold harmless Schuyler Bailar, any Facilitator(s), Pinkmantaray, LLC, and its officers, directors, employees, contractors, and volunteers(collectively, the “Waived Parties”), from any and all liability, claim(s),demand(s), cause(s) of action, damage(s), loss, or expense, including court costs and reasonable attorney’s fees of any kind or nature whatsoever (together and separately, “Liability”) which may arise out of, result from, or relate to my participation.

I further agree that if, despite this Agreement, I or anyone on my behalf makes a claim for Liability against any of the Waived Parties, I will indemnify, defend, and hold harmless the Waived Parties from any such Liability which may be incurred as a result of such a claim.

I agree that I will not share Support Session(s)access information (web link, URL, password, addresses, telephone numbers, etc.) with anyone, and that I will not allow anyone to share my Support Session connection without informing Schuyler Bailar and without their individual registration per this page. I understand that I will be solely responsible for any breach of these covenants.
